On July 1, 2021 Oregon’s Marion County had 186 of the 730 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was first in foreign national crime in the state with 25.48 percent of the criminal aliens in DOC prisons.

Information obtained from the Oregon Department of Corrections (DOC) indicated on July 1, 2021 revealed that 27 of the 730 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for drug crimes — 3.70 percent of the criminal alien prison population.

Using DOC U.S. Immigration and Customs Enforcement (ICE) immigration detainer numbers, the following table reveals the total number criminal alien inmates in the DOC prison system along with the number and percentage of those alien inmates incarcerated on July 1st in the state’s prisons for drug crimes.

Six Oregon counties, Washington (6 alien drug criminals), Multnomah (5 alien drug criminals), Marion (4 alien drug criminals), Jackson (2 alien drug criminals), Josephine (2 alien drug criminals) and Union (2 alien drug criminals) had 21 of 27 criminal alien inmates incarcerated in DOC prisons for drug crimes — 77.78 percent of the alien inmates incarcerated for drug crimes.

It has been an interesting the third full week in the month of August 2021 when it comes to criminal aliens (illegal aliens) here in the Pacific Northwest states of Oregon, Washington and Idaho.

This week we have a “Criminal Alien of the Week Report” for your radio listeners on a previously removed illegal alien who has a history of crime in the state of Oregon.

On August 3, 2021 in the United States District Court for the District of Oregon (Case No. 3:19-cr-00407-SI) Agustin Machic-Xiap (DOB: 09/08/1977), age 43, lost a motion to dismiss his indictment for unlawful reentry into the country after having been previously removed.

Not included in the United States District Court judge’s opinion to deny Agustin Machic-Xiap’s motion to dismiss his indictment for unlawful reentry into the country were the current and past criminal convictions that caused federal immigration enforcement authorities to remove or more recently attempt to remove again him from the country.

An OREGON JUDICIAL DEPARTMENT – Online Records Search reveals the majority of the criminal and misdemeanor cases having been adjudicated in Washington County Circuit Court involving Agustin Machic-Xiap:

• File Date: 06/20/2019: Case Number: 19CR40477: Charge Date 06/11/2019 one count of Driving Under the Influence of Intoxicants, one count of Failure to Perform Duties of Driver-Property Damage, two counts of Criminal Mischief in the Second Degree, and one count Recklessly Endangering Another Person.

Convicted on 08/12/2019 of one count of Driving Under the Influence of Intoxicants, one count of Criminal Mischief in the Second Degree and Recklessly Endangering Another Person.

Sentenced on 08/12/2019 to incarceration of 30-days in County Jail.

• File Date: 10/16/2002: Case Number: D0205481T: Charge Date 10/05/2002 one count of Driving Under the Influence of Intoxicants.

Convicted on 12/05/2002 of one count of Driving Under the Influence of Intoxicants.

Seeking information on the historical immigration status of Agustin Machic-Xiap the “Criminal Alien of the Week Report” on Friday, August 13, 2021 contacted via e-mail U.S. Immigration and Customs Enforcement (ICE) Public Affairs Officer (PAO) David Yost.

On Wednesday, August 18, 2021 ICE Public Affairs Officer Yost responded via e-mail with the following statement on Agustin Machic-Xiap:

“Agustin Machic-Xiap is a Guatemalan national who is unlawfully present in the United States and a priority for removal under the U.S. Department of Homeland Security guidelines due to his lengthy criminal history. Machic-Xiap was encountered by the legacy Immigration and Naturalization Services in October 1996, and he was granted a voluntary departure in May 1999 by an immigration judge. He failed to depart under the terms of his agreement and was detained U.S. Immigration and Customs Enforcement in June 2005 and removed in July 2005. In June 2019, Machic-Xiap was encountered at the Washington County Jail, Oregon, after being convicted of driving under the influence of intoxicants, criminal mischief and reckless endangerment. A detainer placed with the Washington County Jail was not honored and he was released from jail into the community. ICE detained Machic-Xiap in September 2019, and he was indicted in U.S. District Court for illegal reentry to the U.S. Machic-Xiap is currently at-large after his pre-trial release while awaiting his federal case.” – David Yost, ICE Public Affairs Officer.

Under federal law, U. S. Immigration and Customs Enforcement (ICE) has the authority to lodge immigration detainers with law enforcement partners who have custody of individuals arrested on criminal charges and who ICE has probable cause to believe are removable noncitizens. The detainer form asks the other law enforcement agency to notify ICE in advance of release and to maintain custody of the noncitizen for a brief period of time so that ICE can take custody of that person in a safe and secure setting upon release from that agency’s custody.

In accordance with the interim civil immigration enforcement priorities, U.S. Immigration and Customs Enforcement (ICE) is focusing its limited resources on national security, border security, and public safety. ICE will continue to carry out the duties of enforcing the laws of the United States to further the security and safety of our communities. .” – ICE Public Affairs.

If at all possible, the “Criminal Alien of the Week Report” will try to track if federal immigration enforcement authorities are successful in removing Guatemalan national immigration violator Agustin Machic-Xiap from the country.

Information obtained from the Oregon Department of Corrections (DOC) indicated on July 1, 2021 that 424 of 730 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for three types of sex crimes — rape, sex abuse and sodomy — 58.08 percent of the criminal alien prison population (Note: The number of criminal aliens incarcerated for sex crimes in DOC prisons does not necessarily equal the number of Oregon residents victimized by alien rape, sex abuse and sodomy.).

Using DOC U.S. Immigration and Customs Enforcement (ICE) immigration detainer numbers, the following table is a numerical breakdown by number and percentage of the 424 criminal alien inmates incarcerated on July 1st in the state’s prisons for the crimes of rape, sex abuse and sodomy.

Criminal aliens incarcerated in DOC prisons committed at least one sex crime in 24 of 36 Oregon counties — 66.67 percent of the counties in the state.

Seven Oregon counties, Marion (112 alien sex offenders), Washington (102 alien sex offenders), Multnomah (74 alien sex offenders), Lane (25 alien sex offenders), Clackamas (21 alien sex offenders), Yamhill (14 alien sex offenders) and Jackson (12 alien sex offenders) had 360 of 424 criminal alien inmates incarcerated in DOC prisons for sex crimes — 84.91 percent of the alien sex offenders incarcerated in the state’s prisons.

Information obtained from the Oregon Department of Corrections (DOC) indicated on July 1, 2021 that 110 of the 730 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for homicidal crimes (various degrees of murder and manslaughter) — 15.07 percent of the criminal alien prison population (Note: The number of criminal aliens incarcerated for homicidal crimes in DOC prisons does not necessarily equal the number of Oregon residents killed by alien homicidal violence).

Seven Oregon counties, Multnomah (26 alien inmates convicted of homicidal crimes), Marion (23 alien inmates convicted of homicidal crimes), Washington (17 alien inmates convicted of homicidal crimes), Umatilla (9 alien inmates convicted of homicidal crimes), Clackamas (7 alien inmates convicted of homicidal crimes), Jackson (4 alien inmates convicted of homicidal crimes) and Lane (3 alien inmates convicted of homicidal crimes) had 89 of 110 criminal alien inmates incarcerated in DOC prisons for homicidal violence — 80.91 percent of the alien inmates in the state’s prisons for homicidal crimes.

It has been an interesting the second full week in the month of August 2021 when it comes to criminal aliens (illegal aliens) here in the Pacific Northwest states of Oregon, Washington and Idaho.

This week we have a “Criminal Alien of the Week Report” to share with radio listeners on the identity of two criminal aliens who one-year-ago-today (August 12, 2020) were in U.S. Immigration and Customs Enforcement (ICE) custody on unmarked buses in the Central Oregon town of Bend when anti-ICE protesters attempted to block ICE agents removing them from the community.

As soon as “Criminal Alien of the Week Report” found out about a live ongoing incident between ICE agents and anti-ICE protesters the “criminal alien report” contacted ICE Public Affairs Officer (PAO) Tanya Roman via e-mail to find out the identity of the two men in ICE custody.

Here are a series of e-mails from August 12, 2020 and August 13, 2020 that indicate what information ICE Public Affairs Officer Roman was cleared to share on the men:

– ICE Public Affairs’ e-mail from Wednesday, August 12, 2020 at 10:46 PM.

 “The law enforcement activity in Bend, Oregon is part of U.S. Immigration and Customs Enforcement’s mission to arrest criminal aliens presenting a danger to public safety and take them off the street. The two individuals arrested each had a history of criminal violent behavior.

While ICE respects the rights of people to voice their opinion peacefully, that does not include illegally interfering with their federal law enforcement duties. ICE will take all necessary measures to ensure the safety of its officers and detainees, and will vigorously pursue prosecution against anyone who puts them in harm’s way.” – Tanya Roman, ICE Public Affairs Officer.

“ICE continues to target public safety threats and immigration violators. The two individuals arrested by ICE have criminal records that include convictions for assault, harassment, coercion, and criminal trespassing. They are also repeat immigration violators who were previously encountered by U.S. immigration officials and granted voluntary return to their home countries.” – Tanya Roman, ICE Public Affairs Officer.

Call it true dedication to serving the investigative needs of the media, almost one year later, on Wednesday, August 11, 2021 ICE Public Affairs Officer David Yost cleared up many past questions the “Criminal Alien of the Week Report” might have on the identity of the men in ICE custody in Bend, Oregon.

“U.S. Immigration and Customs Enforcement (ICE) officers encountered two individuals in Deschutes County, Oregon, during a 2020 targeted enforcement operation.

Josue Arturo Cruz Sanchez, is a citizen of Mexico. Sanchez was encountered in August 2020 and was subsequently removed to Mexico in October 2020, based on a final order of removal issued by a federal immigration judge. He has prior criminal convictions for assault and felony coercion (May 2018) and criminal trespass (February 2020). Sanchez has not been encountered by ICE since his removal in 2020 and is not currently in ICE custody.

Marco Zeferino Rios is a citizen of Mexico who is unlawfully present in the U.S. Rios was previously granted voluntary return to Mexico in December 2004. He has a prior criminal conviction for attempt to commit harassment (June 2019). Following his 2020 arrest by ICE he was released on bond pending removal proceedings before the immigration courts.” – David Yost, ICE Public Affairs Officer.

U.S. Immigration and Customs Enforcement (ICE) continues to focus its enforcement efforts and limited resources on threats to national security, border security, and public safety. ICE carries out its duty to enforce the laws of the United States to further the security and safety of our communities.

ICE respects the legal right of individuals to voice opposition in a public manner, with the expectation that representatives of the U.S. will not have their duties impeded. Agency policies are determined by multiple factors, and are not dictated by a single instance or event.

Non-criminal migrants from Mexico who are encountered by immigration authorities may be granted a “voluntary return” (VR) to their home country. By accepting the VR, the migrant admits that they are illegally present in the United States and agree to be returned as soon as possible. VRs are usually effected within one or two days. A VR does not have the same legal consequences as an official removal (deportation). – ICE Public Affairs.
