It has been an interesting last week in the month of August when it comes to criminal illegal aliens here in the Pacific Northwest states of Oregon, Washington and Idaho.

This week we take a look at for your KXL FM 101.1 Pacific Northwest radio listeners a criminal illegal alien who was recently arrested in the State of Oregon for the deaths of two of the state’s residents.

On Sunday, August 19, 2018 members of the Salem Police Department responded to the location of a traffic accident on Highway 22/ Mission Street SE involving a pickup truck pulling a horse trailer and a motorcycle in Salem, Oregon.

The alleged driver of the pickup truck has been identified as Eduardo de la Lima Vargas, age 40, a resident of Hubbard, Oregon.

According to a Salem Police report, Eduardo de la Lima Vargas, operator of the pickup truck, ran a red light crashing into a motorcycle and critically injuring a male rider and female passenger. Both the man and woman were later declared deceased at Salem Health.

After the traffic accident, Eduardo de la Lima Vargas (SID: 13738050; DOB: 08/20/1978) was arrested by law enforcement and booked into the Marion County Correctional Facility (MCCF) on charges of two counts of Manslaughter in the First Degree, two counts of Reckless Endangering, one count Reckless Driving and one count of Driving Under the Influence of Intoxicants (DUII). Vargas’ bail has been set at $500,000.00.

Salem Police on Monday, August 20, 2018 identified the deceased rider and passenger of the motorcycle as being Logan Wilson, age 34, and Jessica Wilson, age 32, both residents of Salem, Oregon.

Eduardo de la Lima Vargas’ blood alcohol content (BAC) at the time of the crash was determined to be .10 percent.

Wanting to know the actual immigration status of Eduardo de la Lima Vargas, I contacted via e-mail on Monday, August 20, 2018 U.S. Immigration and Customs Enforcement (ICE) Western Region Communications Director (a) Lori K. Haley to investigate if Eduardo de la Lima Vargas was illegally present in the United States of America.

Approximately a four days later, on the afternoon of Friday, August 24, 2018 here is what ICE Western Region Communications Director (a) Lori K. Haley had to say via e-mail in response to my inquiry for information on Eduardo de la Lima Vargas:

“Please see statement below in response to your query:”

“STATEMENT:

On August 23, 2018, ICE deportation officers lodged an immigration detainer with the Marion County Jail on Eduardo De la Lima Vargas, following his arrest for DUI resulting in death. Mr. De la Lima Vargas is a citizen of Mexico illegally residing in the United States.” – Lori K. Haley, ICE Western Region Communications Director (a).

“ON BACKGROUND:

Detainers serve as a legally authorized request, upon which a law enforcement agency may rely, to continue to maintain custody of an alien for up to 48 hours so that ICE may assume custody for removal purposes. Pursuant to ICE policy, all ICE detainers are submitted with an accompanying administrative arrest warrant or warrant of removal depending upon the circumstances of the individual case. ICE places immigration detainers when the agency possesses probable cause to believe an alien is deportable from the United States.

• The Marion County Jail does not honor any aspect of an ICE detainer, absent a criminal arrest warrant issued by a magistrate judge.

• There is no federal criminal charge for which to obtain a federal judicial arrest warrant for Mr. De la Lima Vargas. However, an administrative arrest warrant, the issuance of which is based on probable cause and issued in accordance with federal law and regulation, is a valid arrest warrant.” – ICE Public Affairs.

Analysis of the preceding information:

U.S. Immigration and Customs Enforcement (ICE) Western Region Communications Director (a) Lori K. Haley answered my question on whether or not Eduardo De la Lima Vargas was illegally present in the USA when he allegedly ran a red light while intoxicated that ultimately resulted in the killing of Logan and Jessica Wilson in this way:

“De la Lima Vargas is a citizen of Mexico illegally residing in the United States.” – Lori K. Haley, ICE Western Region Communications Director (a).

In an on background statement ICE Public Affairs’ answered my question about whether or not the Marion County Correctional Facility would honor an ICE detainer placed on Eduardo De la Lima Vargas while he was incarcerated at MCCF in this way:

“The Marion County Jail does not honor any aspect of an ICE detainer, absent a criminal arrest warrant issued by a magistrate judge.” – ICE Public Affairs.

Furthermore, ICE Public Affairs’ revealed in the same on background statement information on the crimes allegedly committed by Eduardo De la Lima Vargas:

“There is no federal criminal charge for which to obtain a federal judicial arrest warrant for Mr. De la Lima Vargas.” – ICE Public Affairs.

According to the ICE Public Affairs’ on background statement, the only legal tool that ICE has to deal with Eduardo De la Lima Vargas is an administrative arrest warrant:

“However, an administrative arrest warrant, the issuance of which is based on probable cause and issued in accordance with federal law and regulation, is a valid arrest warrant.” – ICE Public Affairs.

Summing up this report, Marion County Sheriff Jason Myers, the public official who is ultimately responsible for the procedures and policies of the MCCF, will not honor ICE detainers or grant access to ICE agents using an administrative arrest warrant to take custody of Eduardo De la Lima Vargas.

On July 1, 2018 Oregon’s Washington County had 200 of the 943 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was second in foreign national crime in the state with 21.21 percent of the criminal aliens in DOC prisons.

The following table reveals how Washington County residents were harmed or victimized by the 200 criminal aliens incarcerated on July 1st in the DOC prison system with U.S. Immigration and Customs Enforcement (ICE) ICE detainers.

On July 1, 2018 Oregon’s Multnomah County had 186 of the 943 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was third in foreign national crime in the state with 19.72 percent of the criminal aliens in DOC prisons.

Information obtained from the Oregon Department of Corrections (DOC) indicated on July 1, 2018 that 172 of 943 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for the crime of rape — 18.24 percent of the criminal alien prison population (Note: The number of criminal aliens incarcerated for rape in DOC prisons does not necessarily equal the number of Oregon residents victimized by the violent crime of rape).

Using DOC U.S. Immigration and Customs Enforcement (ICE) immigration detainer numbers, the following table reveals the total number of criminal alien inmates along with the number and percentage of those alien inmates incarcerated on July 1st in the state’s prisons for the crime of rape.

Significant numbers, the 172 criminal aliens in the DOC prison system incarcerated for rape were 17.64 percent of all inmates, domestic and foreign, in the state’s prisons for the crime of rape.

Using the DOC Inmate Population Profile and ICE immigration detainer numbers from July 1st, the following table reveals the total number inmates incarcerated for rape, the number of domestic and criminal alien inmates incarcerated for rape and the percentage rapes committed by criminal aliens.

Criminal aliens incarcerated in DOC prisons committed at least one crime of rape in 20 of 36 Oregon counties —55.56 percent of the counties in the state.

Five Oregon counties, Marion (48 rapists), Washington (44 rapists), Multnomah (25 rapists), Lane (13 rapists) and Clackamas (10 rapists) had 140 of 172 criminal alien inmates incarcerated in DOC prisons for the crime of rape — 81.40 percent of the alien inmates incarcerated for rape.

Using DOC ICE immigration detainer numbers, the following table reveals the number and percentage of criminal alien inmates incarcerated on July 1st that were sent to prison from the state’s 36 counties for the crime of rape.

Foreign nationals who declared their country or origin as being Mexico were 140 of 172 criminal aliens convicted of rape incarcerated in the DOC prison system — 81.40 percent of the alien rapists in the state’s prisons.

It has been an interesting second full week in the month of August when it comes to criminal aliens here in the Pacific Northwest states of Oregon, Washington and Idaho.

This week we take a look at for your KXL FM 101.1 Pacific Northwest radio listeners three criminal aliens who were arrested and convicted in the State of Oregon for the November 2010 plot and attempt to kidnap a now former Columbia Sportswear Chairwoman.

What sparked my interest to do this report was Columbia Sportswear Corporation’s recent support of Oregon’s 1987 Sanctuary Statute ORS 181A.820.

On July 29, 2018 Tim Boyle, Columbia Sportswear CEO, wrote an editorial that was published in the Oregonian Newspaper titled “We are a state and nation of immigrants. Remember that when you vote on Measure 105” expressing his opposition to Measure 105.

An important fact, Measure 105 (Formerly Initiative Petition 22) if passed by Oregon voters in the 2018 General Election would abolish ORS 181A.820 and allow state, county and local law enforcement to fully cooperated in the enforcement of the United States of America’s immigration laws.

Back to events of November of 2010: Nestor Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo were all arrested for the kidnapping plot and attempt of, at that time, 87 year-old Gert Boyle, Columbia Sportswear Chairwoman, in Clackamas County, Oregon (For those who have not made the family connection yet, Gert Boyle is Tim Boyle’s mother).

Clackamas County Jail records from April 14, 2011 indicate the following criminal charges were filed against Nestor Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo:

Nestor Gabriel Caballero Gutierrez, age 40, was arrested on November 11, 2010. Gutierrez was charged with one count of First Degree Kidnapping, one count of Second Degree Kidnapping, two counts of Criminal Conspiracy, two counts of Solicitation to Commit a Crime, one count of Assault Four, one count of Robbery Two, one count of Burglary One and one count of Coercion. His bail was set at $500,000.00.

Ramon Alberto Midence, age 42, was arrested on November 14, 2010. Midence was charged with one count of First Degree Kidnapping, one count of Second Degree Kidnapping, two counts of Criminal Conspiracy, one count of Solicitation to Commit a Crime, one count of Robbery Two and one count of Burglary One. His bail was set at $500,000.00.

Jose Luis Arevalo, age 47, was arrested on November 15, 2010. Arevalo was charged with one count of First Degree Kidnapping, one count of Second Degree Kidnapping, two counts of Criminal Conspiracy, one count of Robbery Two and one count of Burglary One. His bail was set at $500,000.00.

During the time period 2010 – 2011 when Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo were incarcerated at the Clackamas County Jail. The jail honored U.S. Immigration and Customs Enforcement (ICE) detainers that were placed on the three men. The ICE detainers prohibited jail deputies from releasing them on bail.

On April 14, 2011 in a Clackamas County Circuit Court room Nestor Gabriel Caballero Gutierrez, the kidnap plot ringleader, pled guilty to one count of First Degree Kidnapping, one count of Burglary One and one count of Robbery Two. He was sentenced to 14 ½ years in prison.

Ramon Alberto Midence, a kidnap plot coconspirator, pled guilty to one count of First Degree Kidnapping, one count of Burglary One and one count of Robbery Two. He was sentenced to 9 ½ years in prison.

Jose Luis Arevalo, also a kidnap plot coconspirator, pled guilty to similar crimes and he was sentenced to approximately 6 years in prison.

Because of prior plea agreements all three men received lighter prison sentences for their crimes.

Columbia Sportswear Chairwoman Gert Boyle did not appear at the sentencing of Gabriel Caballero Gutierrez, Ramon Alberto Midence or Jose Luis Arevalo but she released a statement through her attorney. Here is a significant excerpt from Gert Boyle’s statement:

“My family and I welcome today’s Sentencing Hearing as a final step in holding these three criminals accountable for their appalling crimes. They caused me to suffer indignity, violence and indescribable fear.” – Gert Bolye

Currently, Nestor Gabriel Caballero Gutierrez and Ramon Alberto Midence are still incarcerated in the Oregon Department of Corrections (DOC) prison system for their crimes.

Nestor Gabriel Caballero Gutierrez, age 47 (SID: 18715554; DOB: 11/29/1970) is incarcerated at the Two Rivers Correctional Institution. Gutierrez’s earliest release date from the DOC prison system is May 11, 2025.

Ramon Alberto Midence, age 49 (SID: 18719938; DOB: 01/09/1969) is incarcerated at the Snake River Correctional Institution. Midence’s earliest release date from the DOC prison system is May 15, 2020.

Jose Luis Arevalo’s , age 54 (SID: 18721077; DOB: 08/04/1963), current location is not available on VINE Victim Information and Notification Everyday.

Wanting to know the actual immigration status of Nestor Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo, I contacted via e-mail on Monday, July 19, 2018 U.S. Immigration and Customs Enforcement (ICE) Public Affairs Officer Carissa Cutrell to investigate if Nestor Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo were illegally present in the United States of America.

Approximately a week later, on the afternoon of Friday, July 27, 2018 here is what ICE Public Affairs Officer Carissa Cutrell had to say via e-mail in response to my inquiry for information on Nestor Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo:

“Please see the statement below:”

“ICE has lodged detainers with the Oregon Department of Corrections on Nestor Gabrial Caballero-Guttierez and Ramon Alberto Midence-Valle, both nationals of Honduras. Both of these aliens are serving lengthy sentences for egregious felony convictions, including kidnapping.”

“Jose Arevalo-Aguilar entered ICE custody as a convicted aggravated felon Sept. 16, 2016. An immigration judge with the Executive Office for Immigration Review issued Arevalo-Aguilar a final order of removal Oct. 18, 2016, and ICE removed him to Guatemala Oct. 26, 2016. Arevalo-Aguilar had multiple felony convictions for egregious offenses including inflicting corporal injury to spouse/cohabitant, robbery, kidnapping and burglary. ”– Carissa Cutrell, ICE Public Affairs Officer.

Not getting my initial July 19, 2018 question to ICE Public Affairs Officer Cutrell answered on whether Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo were illegally present in the country, I contacted ICE Public affairs on August 7, 2018 with the following question:

“Were Nestor Gabriel Caballero Gutierrez, Ramon Alberto Midence or Jose Luis Arevalo illegally present in the United States of America during 2010 kidnapping attempt of, at that time, 87-year-old Columbia Sportswear Chairman Gert Boyle in Clackamas County, Oregon?”

On the same day in an information background statement an ICE official responded in this way to my preceding question: “No, they are removable based on their criminal convictions.”– ICE Public Affairs.

Analysis of the preceding information:

It is difficult to comprehend and unravel the thinking of Columbia Sportswear Corporation or CEO Tim Boyle’s current support of Oregon’s 1987 Sanctuary Statute ORS 181A.820 or the Sportswear Corporation or Mr. Boyle’s collective opposition to Measure 105 when less than eight years ago three criminal aliens from two Third World Central American countries, two men from Honduras and one man from Guatemala, plotted and attempted to kidnap Tim’s mother Gert Boyle, at that time Chairwoman of the company.

According to ICE Public Affairs, Nestor Gabriel Caballero Gutierrez, Ramon Alberto Midence and Jose Luis Arevalo were legally present in the United States of America (USA) when they orchestrated the plot and attempt to kidnap Gert Boyle, now former Columbia Sportswear Chairwoman.

I was unable to find out the circumstances that brought Honduran nationals Nestor Gabriel Caballero Gutierrez and Ramon Alberto Midence or Guatemalan national Jose Luis Arevalo legally to this county.

Apparently when times got financially tough for the three men in the “land of freedom and opportunity” they regressed to what bad people do in Central American countries from which they had arrived, they plotted and attempted to kidnap a rich person.

Nestor Gabriel Caballero Gutierrez and Ramon Alberto Midence are two of the 24 criminal aliens with ICE detainers incarcerated in the DOC prison system for the crime of kidnapping.

Criminal aliens were 24 of 278 inmates incarcerated in the DOC prison system for the crime of kidnapping — 8.63 percent of all inmates incarcerated for kidnapping in the state’s prisons.

Here is the good news from this report, U.S. Immigration and Customs Enforcement is at least, even in state with a Sanctuary Statute, able in find some level of cooperation with the Oregon Department of Corrections turning over criminal aliens after they complete DOC prison sentences. Case in point, the DOC turned over Jose Luis Arevalo to ICE for what would turn out to be him being removed from the country for being an aggravated felon.

We can only hope the cooperation between ICE and DOC continues so criminal alien aggravated felons like Nestor Gabriel Caballero Gutierrez and Ramon Alberto Midence are removed from the country after they complete prison sentences in the state.

Information obtained from the Oregon Department of Corrections (DOC) indicated on July 1, 2018 that 136 of the 943 foreign nationals (criminal aliens) in the state’s prison system were incarcerated for homicidal crimes (various degrees of murder and manslaughter) —14.42 percent of the criminal alien prison population (Note: The number of criminal aliens incarcerated for homicidal crimes in DOC prisons does not necessarily equal the number of Oregon residents killed by alien homicidal violence).

Using DOC U.S. Immigration and Customs Enforcement (ICE) immigration detainer numbers, the following table reveals the total number criminal alien inmates along with the number and percentage of those alien inmates incarcerated on July 1st in the state’s prisons for homicidal crimes.

Criminal aliens incarcerated in DOC prisons committed at least one crime of homicidal violence in 22 of 36 Oregon counties —66.11 percent of the counties in the state.

Seven Oregon counties, Multnomah (38 alien inmates convicted of homicides), Marion (24 alien inmates convicted of homicides), Washington (21 alien inmates convicted of homicides), Umatilla (9 alien inmates convicted of homicides), Clackamas (7 alien inmates convicted of homicides), Lane (6 alien inmates convicted of homicides) and Jackson (5 alien inmates convicted of homicides) had 110 of 136 criminal alien inmates incarcerated in DOC prisons for homicidal violence — 80.88 percent of the alien inmates in the state’s prisons for homicidal crimes.

Using DOC ICE immigration detainer numbers, the following table reveals the number and percentage of criminal alien inmates incarcerated on July 1st that were sent to prison from the state’s 36 counties for homicidal crimes.

Criminal aliens from 19 different countries have committed homicidal violence against Oregon residents.

Foreign nationals who declared their country or origin as being Mexico were 106 of 136 criminal aliens convicted of homicidal crimes incarcerated in the DOC prison system — 77.94 percent of the alien inmates in the state’s prisons for homicidal crimes.

The Oregon Department of Corrections (DOC) July 1, 2018 Inmate Population Profile indicated there were 14,916 inmates incarcerated in the DOC’s 14 prisons.

Data obtained from the DOC indicated that on July 1st there were 943 foreign nationals (criminal aliens) incarcerated in the state’s prison system; criminal aliens were 6.32 percent of the total prison population.

Some background information, all the criminal aliens incarcerated in the DOC prison system were identified by U.S. Immigration and Customs Enforcement (ICE) and have ICE detainers placed on them.

Using DOC Inmate Population Profiles and ICE detainer numbers, the following table reveals the total number inmates, the number of domestic and criminal alien inmates along with the percentage of inmates with ICE detainers incarcerated on July 1st in the state’s prisons.

Beyond the DOC criminal alien incarceration numbers and incarceration percentages, per county and per crime type, or even country of origin, criminal aliens pose high economic cost on Oregonians.

An individual prisoner incarcerated in the DOC prison system costs the state approximately ($108.26) per day.

The DOC’s incarceration cost for its 943 criminal alien prison population is approximately ($102,089.18) per day, ($714,624.26) per week, and ($37,262,550.70) per year.

None of preceding cost estimates for the DOC to incarcerate the 943 criminal aliens includes the dollar amount for legal services (indigent defense), language interpreters, court costs, or victim assistance.

The United States having a significant foreign national population residing within the nations boundaries, be they legally or illegally present in the country, unfortunately includes those who commit crimes.

The extent and impact of foreign national crime on the U.S. citizens and residents of this country is clearly revealed by a simple search on the U.S. Federal Bureau of Prisons (BOP) inmates statistics website under the heading of inmate citizenship.

Here are the countries of origin, moreover, the number and percentage of those countries citizens recently incarcerated in the U.S. BOP prison system (Note: The most recent BOP crime numbers available were from July 28, 2018.).

Inmate Citizenship:

– México 22,752 inmates, 12.4 percent;
– Colombia 1,648 inmates, 0.9 percent;
– Dominican Republic 1,438 inmates, 0.8 percent;
– Cuba 1,199 inmates, 0.7 percent;
– Other / unknown countries 9,932 inmates, 5.4 percent;
– United States 146,394 inmates, 79.8 percent;

Total Inmates: 183,363 inmates.

To explain the meaning of these preceding criminal alien inmate numbers and percentages, I will translate them into words:

Combining July 28th BOP criminal alien inmate numbers, there were 36,969 criminal aliens in the BOP prison system. Alien inmates were 20.2 percent of the federal prison population; more than two in every ten inmates were criminal aliens.

With 22,752 Mexican nationals being incarcerated in the BOP prison system, at 61.5 percent, they were the vast majority of criminal aliens in federal prisons.

The U.S. Federal Bureau of Prisons breaks down the federal prison population into 13 types of offenses. One of the top five offenses, the reason inmates are serving time in federal prisons is for immigration crimes. There were 11,557 inmates in the BOP prison system incarcerated for immigration crimes; they were 6.8 percent of the federal prison population.

On June 1, 2018 Oregon’s Marion County had 235 of the 957 foreign nationals (criminal aliens) incarcerated in the Oregon Department of Corrections (DOC) prison system; the county was first in foreign national crime in the state with 24.56 percent of the criminal aliens in DOC prisons.

The following table reveals how Marion County residents were harmed or victimized by the 235 criminal aliens incarcerated on June 1st in the DOC prison system with U.S. Immigration and Customs Enforcement (ICE) ICE detainers.
