Lars Larson Show: Criminal Alien of the Week Report

It has been an interesting last week in the month of August when it comes to criminal illegal aliens here in the Pacific Northwest states of Oregon, Washington and Idaho.
This week we take a look at for your KXL FM 101.1 Pacific Northwest radio listeners a criminal illegal alien who was recently arrested in the State of Oregon for the deaths of two of the state’s residents.
On Sunday, August 19, 2018 members of the Salem Police Department responded to the location of a traffic accident on Highway 22/ Mission Street SE involving a pickup truck pulling a horse trailer and a motorcycle in Salem, Oregon.
The alleged driver of the pickup truck has been identified as Eduardo de la Lima Vargas, age 40, a resident of Hubbard, Oregon.
According to a Salem Police report, Eduardo de la Lima Vargas, operator of the pickup truck, ran a red light crashing into a motorcycle and critically injuring a male rider and female passenger. Both the man and woman were later declared deceased at Salem Health.
After the traffic accident, Eduardo de la Lima Vargas (SID: 13738050; DOB: 08/20/1978) was arrested by law enforcement and booked into the Marion County Correctional Facility (MCCF) on charges of two counts of Manslaughter in the First Degree, two counts of Reckless Endangering, one count Reckless Driving and one count of Driving Under the Influence of Intoxicants (DUII). Vargas’ bail has been set at $500,000.00.
Salem Police on Monday, August 20, 2018 identified the deceased rider and passenger of the motorcycle as being Logan Wilson, age 34, and Jessica Wilson, age 32, both residents of Salem, Oregon.
Eduardo de la Lima Vargas’ blood alcohol content (BAC) at the time of the crash was determined to be .10 percent.
Wanting to know the actual immigration status of Eduardo de la Lima Vargas, I contacted via e-mail on Monday, August 20, 2018 U.S. Immigration and Customs Enforcement (ICE) Western Region Communications Director (a) Lori K. Haley to investigate if Eduardo de la Lima Vargas was illegally present in the United States of America.
Approximately a four days later, on the afternoon of Friday, August 24, 2018 here is what ICE Western Region Communications Director (a) Lori K. Haley had to say via e-mail in response to my inquiry for information on Eduardo de la Lima Vargas:
“Please see statement below in response to your query:”
“STATEMENT:
On August 23, 2018, ICE deportation officers lodged an immigration detainer with the Marion County Jail on Eduardo De la Lima Vargas, following his arrest for DUI resulting in death. Mr. De la Lima Vargas is a citizen of Mexico illegally residing in the United States.” – Lori K. Haley, ICE Western Region Communications Director (a).
“ON BACKGROUND:
Detainers serve as a legally authorized request, upon which a law enforcement agency may rely, to continue to maintain custody of an alien for up to 48 hours so that ICE may assume custody for removal purposes. Pursuant to ICE policy, all ICE detainers are submitted with an accompanying administrative arrest warrant or warrant of removal depending upon the circumstances of the individual case. ICE places immigration detainers when the agency possesses probable cause to believe an alien is deportable from the United States.
• The Marion County Jail does not honor any aspect of an ICE detainer, absent a criminal arrest warrant issued by a magistrate judge.
• There is no federal criminal charge for which to obtain a federal judicial arrest warrant for Mr. De la Lima Vargas. However, an administrative arrest warrant, the issuance of which is based on probable cause and issued in accordance with federal law and regulation, is a valid arrest warrant.” – ICE Public Affairs.
Analysis of the preceding information:
U.S. Immigration and Customs Enforcement (ICE) Western Region Communications Director (a) Lori K. Haley answered my question on whether or not Eduardo De la Lima Vargas was illegally present in the USA when he allegedly ran a red light while intoxicated that ultimately resulted in the killing of Logan and Jessica Wilson in this way:
“De la Lima Vargas is a citizen of Mexico illegally residing in the United States.” – Lori K. Haley, ICE Western Region Communications Director (a).
In an on background statement ICE Public Affairs’ answered my question about whether or not the Marion County Correctional Facility would honor an ICE detainer placed on Eduardo De la Lima Vargas while he was incarcerated at MCCF in this way:
“The Marion County Jail does not honor any aspect of an ICE detainer, absent a criminal arrest warrant issued by a magistrate judge.” – ICE Public Affairs.
Furthermore, ICE Public Affairs’ revealed in the same on background statement information on the crimes allegedly committed by Eduardo De la Lima Vargas:
“There is no federal criminal charge for which to obtain a federal judicial arrest warrant for Mr. De la Lima Vargas.” – ICE Public Affairs.
According to the ICE Public Affairs’ on background statement, the only legal tool that ICE has to deal with Eduardo De la Lima Vargas is an administrative arrest warrant:
“However, an administrative arrest warrant, the issuance of which is based on probable cause and issued in accordance with federal law and regulation, is a valid arrest warrant.” – ICE Public Affairs.
Summing up this report, Marion County Sheriff Jason Myers, the public official who is ultimately responsible for the procedures and policies of the MCCF, will not honor ICE detainers or grant access to ICE agents using an administrative arrest warrant to take custody of Eduardo De la Lima Vargas.
