Lars Larson Show: Criminal Alien of the Week Report

It has been an interesting last full week in the month of April when it comes to criminal aliens here in the State of Oregon.

This week we put another face to alien crime in the state for your radio listeners — the most common alien criminal activity that occurs in our state — sex abuse.

Some historical facts: Tuesday, May 17, 2011 Hermes Franca De Barros, at that time age 37, was arraigned in a Clackamas County Circuit Court on seven counts of First-Degree Sexual Abuse and two counts of Second-Degree Unlawful Sexual Penetration.

On Wednesday, January 4, 2012 De Barros plead guilty in a Clackamas County Court to one count of Unlawful Sexual Penetration and one count of attempted First-Degree Sexual Abuse of a girl under 14 years of age.

Subsequently he was sentenced by a county circuit court judge to 42 months in the Oregon Department of Corrections (DOC) prison system.

Apparently while De Barros was incarcerated at the Clackamas County Jail Immigration and Customs Enforcement (ICE) agents monitoring jail intakes never placed an immigration detainer on him.

Fortunately ICE agents caught their oversight of not placing an immigration detainer on him at the county jail by doing so while he was in incarcerated in the DOC prison system.

An ICE press release from April 23, 2014 announced that Hermes Franca De Barros was being deported, “ICE deports Oregon mixed martial arts fighter to Brazil” (See link).

Here is an important quote from the ICE press release:

“If not for prison officials honoring an ICE detainer, Mr. De Barros would have been released into the community and free to reoffend,” — Nathalie Asher, Field Office Director for ICE Enforcement and Removal Operations (ERO) Seattle, who oversees immigration enforcement in Oregon, Washington and Alaska.

Some fast facts:

– On March 1, 2014 the DOC prison system incarcerated 1,147 criminal aliens (prisoners with immigration detainers); 210 of those alien prisoners (18.31 percent) were serving time for sex abuse;

– Clackamas County Circuit Courts have sent 13 of the 210 criminal aliens (6.19 percent of the aliens) who were serving time on March 1st in the DOC prison system for sex abuse;

– Marion County Circuit Courts have sent 47 of the 210 criminal aliens (22.38 percent of the aliens) who were serving time on March 1st in the DOC prison system for sex abuse;

– Multnomah County Circuit Courts have sent 36 of the 210 criminal aliens (17.14 percent of the aliens) who were serving time on March 1st in the DOC prison system for sex abuse;

– Washington County Circuit Courts have sent 47 of the 210 criminal aliens (22.38 percent of the aliens) who were serving time on March 1st in the DOC prison system for sex abuse.

A troubling fact, at this point in time, the Oregon County Sheriff’s of the four preceding counties have announced that they will no longer hold suspected criminal aliens on just an immigration detainer alone.

Hopefully the Sheriff’s of Clackamas, Marion, Multnomah and Washington counties will reconsider the recent changes they made in immigration detainer policy because there is a lesson to be learned from the Hermes Franca De Barros case — sometimes it takes time for immigration authorities to identify foreign national criminals who prey on the weakest among us — particularly those individuals who perpetrate crimes on children.
