According to the Oregon Department of Corrections (DOC) Inmate Population Profile dated March 1, 2013 DOC indicated there were 14,308 prisoners incarcerated in DOC’s 14 prisons.

Not included in DOC’s March 1st Inmate Population Profile was DOC data indicating there were 1,212 foreign nationals (criminal aliens) incarcerated in its prison system.

All 1,212 criminal aliens incarcerated on March 1st by DOC had United States (U.S.) Department of Homeland Security (DHS), Immigration and Customs Enforcement (ICE), detainers. The U.S. DHS–ICE is responsible for indentifying whether a DOC inmate is a criminal alien or a domestic inmate. If an inmate is identified as being a criminal alien, at U.S. DHS–ICE’s request, the DOC places an “ICE detainer” on the inmate that directs DOC officials to transfer custody to ICE following completion of the inmate’s state sanction.

Criminal aliens made up approximately 8.47% of the DOC March 1st prison population (See table).

When comparing DOC domestic criminal incarceration numbers from March 1, 2008 (12,477 domestic criminals) and March 1, 2013 (13,096 domestic criminals), the DOC prison system incarcerated 619 domestic criminals more than it did on March 1, 2008, a 4.96% increase (See table).

Bringing the preceding numbers together, from March 1st 2008 – 2013, the DOC prison population grew by 770 domestic and criminal alien prisoners; 19.61% of the overall growth was in criminal alien prisoners.

A review of the 1,212 criminal aliens in DOC prisons by number per county and percentage (%) per county equated to the following: 0-Baker (0.00%), 17-Benton (1.40%), 86-Clackamas (7.09%), 4-Clatsop (0.33%), 2-Columbia (0.16%), 9-Coos (0.74%), 3-Crook (0.25%), 0-Curry (0.00%), 17-Deschutes (1.40%), 6-Douglas (0.49%), 1-Gilliam (0.08%), 0-Grant (0.00%), 0-Harney (0.00%), 7-Hood River (0.58%), 55-Jackson (4.54%), 11-Jefferson (0.91%), 7-Josephine (0.58%), 10-Klamath (0.82%), 0-Lake (0.00), 66-Lane (5.44%), 8-Lincoln (0.66%), 28-Linn (2.31%), 12-Malheur (0.99%), 278-Marion (22.94%), 5-Morrow (0.41%), 277-Multnomah (22.85%), 1-OOS (0.08%), 18-Polk (1.48%), 0-Sherman (0.00%), 5-Tillamook (0.41%), 18-Umatilla (1.48%), 3-Union (0.25), 0-Wallowa (0.00%), 3-Wasco (0.25%), 222-Washington (18.32%), 0-Wheeler (0.00%), and 33-Yamhill (2.72%).

No member of the Oregon State Legislature should forget the uncounted crime victims and their families, no matter what their immigration status, all victims of the 1,212 criminal aliens incarcerated in DOC prisons.

A review of the 1,212 criminal aliens in the DOC prison population by numbers per crime and percentage (%) per crime equated to the following: 4-arsons (0.33%), 130-assaults (10.73%), 26-burglaries (2.14%), 30-driving offenses (2.47%), 165-drugs (13.61%), 1-escape (0.08%), 4-forgeries (0.33%), 147-homicides (12.13%), 50-kidnappings (4.12%), 65-others (5.36%), 172-rapes (14.19%), 77-robberies (6.35%), 228-sex abuses (18.81%), 93-sodomies (7.67%), 15-thefts (1.24%), and 5-vehicle thefts (0.41%).

Oregon State Legislators should not overlook the source of the preceding crimes, the country of origin of the 1,212 criminal aliens in DOC prisons.

The self-declared counties of origin of the 1,212 criminal aliens in the DOC prison population by numbers and percentage (%) per country equated to the following: 8-Canada (0.66%), 10-Cuba (0.82%), 18-El Salvador (1.48%), 34-Guatemala (2.80%), 16-Honduras (1.32%), 8-Laos (0.66%), 987-Mexico (81.43%), 7-Philippines (0.58%), 92-others (7.59%), 14-Ukraine (1.15%), and 18-Vietnam (1.48%).

Beyond the DOC criminal alien incarceration numbers and incarceration percentages, per county and per crime type, or even country of origin, criminal aliens pose high economic cost on Oregonians.

An individual prisoner in the DOC prison system costs approximately ($84.81) per day to incarcerate (See link).

The DOC’s incarceration cost for its 1,212 criminal alien prison population is approximately ($102,789.72) per day, ($719,528.04) per week, and ($37,518,247.80) per year.

Even taking into account fiscal year 2012 United States Federal Government State Criminal Alien Assistance Program (SCAAP) award of $1,996,569.00 if the State of Oregon receives the same amount of SCAAP funding for fiscal year 2013, the cost to incarcerate 1,212 criminal aliens to the DOC will be at least ($35,521,678.80) (See link).

None of my preceding cost estimates for the DOC to incarcerate the 1,212 criminal aliens include the dollar amount for legal services (indigent defense), court costs, nor cost estimates to cover victim assistance.

An unfortunate fact, the State of Oregon is not fully cooperating with the U.S. DHS–ICE to fight crime committed by criminal aliens who reside in Oregon.

In year 2007, a United States Department of Justice (USDOJ) report titled “Cooperation of SCAAP (State Criminal Alien Assistance Program) Recipients in the Removal of Criminal Aliens from the United States, U.S. Department of Justice, Office of Inspector General Audit Division, Audit Report 07-07, March 2007, Redacted-Public Version” identified the State of Oregon as having an official “state sanctuary statute,” ORS 181.850 Enforcement of federal immigration laws (See link).

The USDOJ, the federal governments top law enforcement agency, identified Oregon as a “sanctuary” for criminal aliens.

An Oregon law, Oregon Revised Statue 181.850 (ORS 181.850), Section (1), prohibits Oregon law enforcement (Oregon State Police (OSP), county sheriffs, city police departments) from asking immigration status of anyone residing in the State of Oregon “for the purpose of detecting or apprehending persons whose only violation of law is that they are persons of foreign citizenship present in the United States in violation of federal immigration laws.” Under ORS 181.850, Section (2), Oregon law enforcement may exchange information with U.S. DHS–ICE . . . “in order to: Subsection (a), “Verify the immigration status of a person if the person is arrested for any criminal offense;” or, Subsection (b), “Request criminal investigation information with reference to persons named in records of the” U.S. DHS–ICE . . . (See link).

The State of Oregon should no longer be classified by U.S. federal government law enforcement as having an official “state sanctuary statute” for criminal aliens, nor should Oregon be a sanctuary for criminal aliens to kill, rape, or maim Oregonians.

Oregonians should contact their Oregon State Senator and Representative and ask them to reintroduce, support and pass legislation like HB 2803 (legislation offered during the 2011 session) during the 2013 legislative session that would empower law enforcement to fight foreign national crime in the state.

Honorable Chairman Beyer, Vice-Chairman Star and Committee Members:

My name is David Olen Cross and I am a resident of Salem, Oregon.

I ask the Senate Committee on Business and Transportation to oppose Senate Bill 833, legislation that would grant some form of Oregon Drivers License (ODL) to foreign nationals illegally in the country (illegal aliens).

The issuing of ODLs to some illegal aliens (prior to the passage of Senate Bill 1080 in 2008 that required legal presence to obtain driver license in this state) who have chosen to drive motor vehicles impaired or recklessly has injured or extinguished the lives of far too many Oregonians of various ages and socio-economic classes across our state.

– Kimberly McDaniel, a 23-year old single woman, was killed on July 15, 2006 in Multnomah County by Rosendo Rosales-Corona (SID: 17078498), a Mexican national illegally in the country (Rosales-Corona fled to Mexico and was latter captured in California when he returned to the U.S. to work);

– Judyth Anne Cox, a 66-year old wife, mother of two and grandmother of six, a resident of Newberg, was killed in Yamhill County on December 3, 2007 by Ignacio Merendon-Zerega (SID: 7213917), a Mexican national illegally in the country (Merendon-Zerega had five prior DUIIs, most occurring in Marion County, at the time he killed Mrs. Cox);

– Carma Colleen Smith, a 52-yeare old wife, mother of seven and grandmother of four, a resident of Dayton, was killed in Yamhill County on May 11, 2008 (Mothers Day) by Leonel Zurita-Loeza (SID: 17045856), a Mexican national illegally in the country (Zurita-Loeza was on a diversion for a previous DUII at the time he killed Mrs. Smith);

– Justin Daniel Dougherty, 23-year old single father of one, was killed in Lane County on March 4, 2008 by Mexican national Eduardo Gutierrez-Duarte (SID: 14044953);

– Kay Blaser, a 26-year old mother of one, was killed in Clackamas County on October 12, 2008 by Mexican national Fernando Deanda-Moreno (SID: 17627417);

– Barbara Jean Bier, a 52-year old wife, mother of seven and grandmother of five, was killed in Polk County on November 21, 2008 by Martin Martinez-Aguilar (SID: 17690098);

– Albert Lloyd Rowland, a 53-year old homeless man, was killed in Multnomah County on May 13, 2010 by Alvaro Lugos-Ponce (SID: 18467984);

– John Zupan (founder of Zupan’s Markets), a 66-year old father of two, was killed in Multnomah County on August 30, 2011 by Edy Porfirio Reynoso-Ramirez (SID: 16599221).

Considering the number of Oregonians (there were more victims than I have listed above) who have been maimed or killed by illegal alien drivers, most with driver license issued prior to 2008’s SB1080, it is unconscionable that any state senator or representative would be willing to sponsor or support such irresponsible and dangerous legislation like SB833 under the guise of it being a public safety issue.

Senate Bill 833 is legislation that would once again open up Oregon’s freeways, highways, roads and streets to the slaughter of its citizens.

Chairman Beyer, Vice-Chairman Star and Committee Members, Oregon families have suffered enough carnage and grief at the hands of illegal alien drivers, I ask the members of the Senate Committee on Business and Transportation to oppose SB833 for the real long term public safety of all Oregon residents.

It has been an interesting first week in the month of April when it comes to criminal aliens here in the State of Oregon.

This week we have news from the Oregon State Capital about legislation (Senate Bill 833) introduced this week that would grant some form of Oregon Drivers License (ODL) to foreign nationals illegally in the country (illegal aliens).

If SB 833 becomes state law the Oregon Department of Transportation would be required to issue short term driver license (4-years) or short term driver permit to applicant who does not provide proof of legal presence in United States but otherwise has complied with all requirements for license or permit and has resided in Oregon for more than one year.

The issuing of ODLs in the recent past to illegal aliens who have chosen to drink and drive has extinguished the lives of far too many Oregonians of all age groups and socio-economic classes across our state.

The sponsors of SB 833 are State Senators Chip Shields (SD-22), Arnie Roblan (SD-5), Chuck Thomsen (SD-26) and Bill Hansell (SD-29); also sponsors are Representatives Jessica Vega Pederson (HD-47), Chris Harker (HD-34), Mark Johnson (HD-52) and Vic Gilliam (HD-18).

Considering how many Oregonians in this state have been maimed or killed by illegal alien drivers it is unconscionable that the preceding Senators and Representatives would be willing to sponsor such irresponsible and dangerous legislation under the guise of a public safety issue.
